1. Introduction
Welcome to Outplore. These Terms of Use (“Terms“) are a binding agreement between you and Outplore Inc. (“Outplore,” “we,” “us“) and govern your access to and use of the Outplore website, mobile applications, and related services (together, the “Platform“). Outplore is a community-driven platform that helps people who are relocating discover, connect, and exchange information with one another and with independent Professionals such as real estate agents and moving companies (“Professionals“). By creating an account or using the Platform, you agree to these Terms, our [Privacy Policy], our [Cookie Policy], our [Community Guidelines], and — for Professionals who subscribe — our [Subscription, Refund & Cancellation Policy], each of which is incorporated by reference. If you do not agree, do not use the Platform. Outplore Inc. is a Delaware corporation registered as a foreign corporation in California.
2. Definitions
- Member — a user who uses the Platform to find information, community, or Professionals in connection with relocating.
- Professional — an independent Professional who uses the Platform to offer or promote services to Members.
- Contributor — a user who shares helpful relocation content, guides, or advice.
- Content — any text, images, audio, video, reviews, listings, profile information, messages, or other material submitted to the Platform.
- Services — the features and functionality made available through the Platform.
- AI Tools — automated and AI-powered features including search, recommendations, matching, and the AI assistant.
3. Eligibility
The Platform is intended only for users who are at least 18 years old and able to form a legally binding contract. By using the Platform, you represent and warrant that you:
- are at least 18 years of age;
- have the legal capacity and authority to agree to these Terms;
- are not barred from using the Platform under any applicable law, sanctions, or export-control regime; and
- will comply with these Terms and all applicable laws.
We do not knowingly allow anyone under 18 to use the Platform. If we learn that a user is under 18, we will terminate their account.
4. Account Registration and Security
To use many features, you must create an account. You agree to:
- provide accurate, current, and complete information and keep it up to date;
- keep your login credentials confidential and not share your account;
- be responsible for all activity under your account; and
- notify us promptly at support@outplore.com of any unauthorized access or security concern.
We may suspend or terminate an account that appears inactive, fraudulent, or in violation of these Terms, consistent with Section 13.
5. Nature of the Platform — Important Limitations
Outplore is a discovery and community platform only. We provide tools to find information, build community, and connect with Professionals, fellow Members heading to the same destination, people who have already relocated and can share their experience, and the broader relocation community. We do not:
- provide relocation, real estate, moving, immigration, visa, legal, financial, tax, or insurance services ourselves;
- provide consultations or advice of any kind — including through the Experts section, which is solely a directory to help you discover independent Professionals;
- act as a party to any agreement, consultation, or arrangement between a Member and a Professional;
- process, facilitate, hold, or guarantee any payment or transaction between users; or
- verify, endorse, or guarantee the identity, qualifications, licensing, availability, conduct, or quality of any user or Professional, except where we expressly state that a specific verification has been performed.
You engage other users entirely at your own discretion and risk. Any service, consultation, agreement, payment, or relocation or immigration matter is arranged and carried out directly between you and the other party, off the Platform. We are not responsible for, and disclaim liability for, the acts, omissions, services, or content of any user or Professional. Do not share sensitive information through Platform messaging. Never share payment card numbers, bank details, or government identification through messages on the Platform. Any request to pay through Platform messaging should be treated as a red flag and reported to support@outplore.com.
6. AI Features, Automated Tools, and Disclosure
6.1 Outplore’s AI Tools.
Parts of the Platform use automated tools and AI — including search, recommendations, matching, and an AI assistant — to surface relevant content, Professionals, and connections. These tools assist you; they do not make decisions for you, and their output may be incomplete or inaccurate. AI output is not professional, legal, financial, immigration, medical, or other advice, and you should independently verify anything you rely on.
6.2 Your use of AI in Content.
You may use AI tools to help draft or edit Content, but you must clearly disclose when Content is substantially AI-generated. You must not:
- present AI-generated text, images, or media as your own genuine first-hand experience;
- post AI-generated reviews — reviews must reflect your real, personal experience with a Professional;
- post synthetic or manipulated media (including deepfakes or AI-altered images of real people) that misrepresent reality; or
- use AI tools to mass-generate Content, spam, or manipulate Platform features.
Undisclosed AI-generated reviews are prohibited and may be removed, consistent with FTC enforcement of fake testimonials and the EU AI Act’s transparency requirements.
7. Acceptable Use
You agree to use the Platform lawfully and respectfully, and in line with our [Community Guidelines]. You will not:
- use the Platform for any unlawful, fraudulent, or deceptive purpose;
- post Content that is illegal, defamatory, misleading, harassing, hateful, threatening, obscene, or that infringes others’ rights;
- impersonate any person or misrepresent your affiliation;
- post or spread misinformation about relocation, immigration, legal, or financial matters;
- solicit, harass, spam, or harvest data about other users;
- post fake, incentivized, AI-generated, or undisclosed-sponsored reviews, or manipulate ratings;
- introduce malware, bots, scrapers, or harmful code, or attempt to disrupt, probe, or circumvent the Platform’s systems or security;
- share another person’s private or sensitive information without permission; or
- use the Platform in any way that violates applicable sanctions, export-control, or anti-money-laundering laws.
We may remove Content and restrict, suspend, or terminate accounts that violate these rules, as described in Section 13.
8. Your Content and Licenses
- Ownership. You retain ownership of the Content you submit.
- License to Outplore. By submitting Content, you grant Outplore a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting and display), publish, distribute, and otherwise use that Content to operate, improve, and promote the Platform. This license ends when you delete your Content or account, except where the Content has been shared with others who have not deleted it, or where we must retain it to comply with law.
- Your responsibility. You represent that you have the rights necessary to grant this license and that your Content does not violate these Terms, our [Community Guidelines], or any third-party right.
- Feedback. If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use it without restriction or obligation to you.
9. Community Groups, Forums, and Reviews
You may create or join groups, forums, and discussions. When you do, you agree to keep discussions respectful and relevant, follow group-specific and community rules, and avoid off-topic promotion. Group creators act as volunteer moderators under our [Group Creator Guidelines] and are not Outplore agents. Reviews and ratings must reflect genuine, first-hand experience. Fake, paid-for, AI-generated, or misleading reviews are prohibited and may be removed. This is consistent with the FTC’s rules on fake and deceptive reviews and the EU’s consumer-protection framework.
10. Professional Subscriptions and Billing
Outplore offers optional paid subscriptions to Professionals. Member use of the core Platform is free, and Outplore does not charge for or process payments relating to services arranged between users. Where you purchase a subscription:
- Clear terms before you pay. We clearly disclose the price, billing frequency, renewal terms, and how to cancel before you are charged, and obtain your express consent.
- Auto-renewal. Subscriptions renew automatically unless cancelled before the renewal date. You can manage auto-renewal through the toggle in your account settings at any time.
- Easy cancellation. You may cancel at any time through your account settings. Cancelling is at least as easy as subscribing, and because you subscribe online you can cancel online. Make changes at least 24 hours before your next billing date.
- Refunds. Governed by our [Subscription, Refund & Cancellation Policy]. Monthly subscriptions are non-refundable. Annual subscriptions may be refundable within 7 days if eligibility conditions are met.
- No lead guarantee. We do not guarantee any specific number of leads, quote requests, views, or results.
- Taxes. Prices are in US Dollars (USD) and may exclude applicable taxes, which you are responsible for.
Payments are handled by our third-party payment processors; we do not store full card numbers.
11. Content Moderation, Reporting, and Appeals
We apply these Terms and our [Community Guidelines] diligently, consistently, and in a non-arbitrary way.
- Reporting illegal or violating content. You can notify us of Content you believe is illegal or violates these Terms by using the in-Platform reporting tools or emailing support@outplore.com. Please identify the specific Content and the reason. We review notices and act where appropriate.
- Action and statement of reasons. Where we remove or restrict Content or an account, we will, where required by applicable law (including the EU Digital Services Act), give the affected user a statement of the reasons for our decision.
- Appeals. If you believe a moderation decision was wrong, email support@outplore.com; we will review appeals promptly. EU users may also refer unresolved disputes to a certified out-of-court dispute-settlement body and contact the Digital Services Coordinator in their Member State.
- Repeat violations. We generally warn before suspending for repeated violations, except where immediate action is needed. We also reserve the right to act without prior warning where a user has demonstrated a pattern of failing to uphold these Terms or our Guidelines.
12. Intellectual Property
The Platform, including its software, design, trademarks, and content we provide (excluding user Content), is owned by Outplore or its licensors and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Platform for its intended purpose. You may not copy, modify, reverse-engineer, or create derivative works except as permitted by law. Copyright complaints. If you believe Content infringes your copyright, send a notice with the details required by applicable law (such as the U.S. Digital Millennium Copyright Act) to support@outplore.com. We will respond to valid notices, including by removing infringing Content and, where appropriate, terminating repeat infringers.
13. Suspension and Termination
We may suspend or terminate your access, with or without notice, where we reasonably believe you have violated these Terms or applicable law, where required for security or legal reasons, or where continued provision is no longer commercially viable. You may stop using the Platform and close your account at any time through your account settings or by emailing support@outplore.com. On termination, your right to use the Platform ends and we may delete your account and Content, subject to our [Privacy Policy] and legal retention obligations. Outplore has no obligation to retain, preserve, or make available any Content after account closure. Sections that by their nature should survive (including content licenses already granted, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.
14. Privacy and Data
We collect and process personal information as described in our [Privacy Policy]. By using the Platform, you acknowledge the practices described there. Where the law requires consent (for example, for certain cookies or marketing), we will ask for it separately.
15. Children's Privacy
The Platform is not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has created an account or provided us information, contact us at support@outplore.com and we will take steps to delete it promptly.
16. Third-Party Links and Services
The Platform may contain links to third-party websites, services, or resources that we do not own or control — including Professional websites, payment processors, and external tools. We are not responsible for the availability, accuracy, content, practices, or policies of any third-party service. Your use of third-party services is governed by their own terms and policies, and we encourage you to review them. A link from the Platform does not imply endorsement.
17. Electronic Communications and Consent
By creating an account, you consent to receive electronic communications from Outplore — including service notifications, account alerts, moderation decisions, and (where you have opted in) marketing and promotional messages. These electronic communications satisfy any legal requirement that such communications be in writing. You can manage your email preferences at any time from your community profile at community.outplore.com/members/your-username/email-preferences/. You can opt out of marketing emails at any time using the unsubscribe link in any promotional email or through your settings. Opting out of marketing does not affect essential service, security, or account-related communications.
18. Accessibility
We are committed to making the Platform accessible and usable for all users, including people with disabilities. We work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you experience barriers or need assistance, contact us at support@outplore.com. 19. Service Availability and Regional Limitations
Outplore is available globally, but we do not represent that the Platform or any feature is available, appropriate, or lawful in every jurisdiction. Some features may be limited or unavailable in certain regions due to legal, regulatory, or technical reasons. You are responsible for ensuring that your use of the Platform complies with the laws of your jurisdiction. If you access the Platform from a location where it is restricted, you do so at your own risk.
20. Mobile Applications
If you access the Platform through a mobile application downloaded from the Apple App Store, Google Play Store, or another app store, you agree that these Terms are between you and Outplore — not the app store provider. The app store provider has no obligation to provide maintenance, support, warranty, or liability for the app. If the app fails to conform to any applicable warranty, the app store provider’s maximum liability is limited to refunding the purchase price of the app (if any). The app store provider is not responsible for addressing your claims or any third-party claims relating to the app, including product liability, intellectual-property, or regulatory claims.
21. Assumption of Risk for Off-Platform Interactions
You acknowledge that interactions, services, consultations, payments, and agreements arranged through the Platform but carried out off the Platform are entirely between you and the other party. Outplore cannot and does not investigate, mediate, enforce, refund, or protect users in connection with disputes, losses, damages, fraud, or any other matter arising from off-platform dealings. Outplore accepts no liability whatsoever for any loss, damage, cost, claim, or expense — whether direct, indirect, financial, physical, or emotional — arising from or related to your off-platform interactions with any user, Professional, or third party, including but not limited to the quality, safety, legality, or outcome of any service provided, any agreement breached, any payment made, or any misrepresentation by another party. You assume all risks associated with engaging other users, including risks of property damage, bodily injury, financial loss, or emotional distress, to the fullest extent permitted by law. This limitation applies regardless of whether Outplore was aware of or advised of the possibility of such risks.
22. Disclaimers
To the fullest extent permitted by law, the Platform is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, timely, or error-free, or that Content (including AI output and information from other users or Professionals) is accurate, complete, or reliable. We are not responsible for delays, outages, data loss, or issues caused by third-party services. User interactions are not actively monitored; use good judgment when engaging with others. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you.
23. Limitation of Liability
To the fullest extent permitted by law:
- Outplore and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Platform or these Terms, even if advised of the possibility.
- Our total aggregate liability arising out of or relating to the Platform or these Terms will not exceed the greater of (a) USD 100 or (b) the total amount you paid Outplore in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing here limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, fraud, or mandatory consumer rights).
24. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Outplore and its affiliates, officers, employees, and agents from claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising from your use of the Platform, your Content, your violation of these Terms or applicable law, or your interactions or dealings with other users.
25. Dispute Resolution and Governing Law
Please read this section carefully — it affects how disputes are resolved.
- Informal resolution first. Before starting any formal proceeding, you agree to contact support@outplore.com and try in good faith to resolve the dispute for at least 30 days.
- Governing law. These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, except where the mandatory law of your country of residence requires otherwise.
- Jurisdiction. Where arbitration does not apply, the state and federal courts of the State of Delaware have exclusive jurisdiction, subject to any mandatory local rights described below.
- Consumer rights preserved. If you are a consumer, nothing in this section deprives you of the protection of mandatory provisions of your local law, including the right to bring proceedings in your local courts. EU/UK and other consumers may have access to local consumer dispute-resolution mechanisms.
26. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, provide reasonable notice (for example, by email or an in-app notification). Continued use of the Platform after the changes take effect means you accept the updated Terms. If you do not agree, stop using the Platform.
27. General
- Entire agreement. These Terms and the policies they incorporate are the entire agreement between you and Outplore regarding the Platform and supersede all prior agreements.
- Severability. If any provision is found unenforceable, the rest remains in full effect.
- No waiver. Our failure to enforce a provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, government actions, cyberattacks, or infrastructure failures.
- Export and sanctions. You agree to comply with applicable export-control and sanctions laws and not to use the Platform if you are subject to relevant restrictions.
- Notices and language. We may send notices through the Platform or by email to the address on your account. These Terms are provided in English; translations are for convenience, and the English version governs unless your local law requires otherwise.
